Waiver and Release
The undersigned hereby acknowledges he/she has inspected and approved the equipment being rented from" Mission Beach Rentals @Belmont" “San Diego Bike Rentals” or "Cheap Rentals" and further assumes all risk and liability in using the equipment rented from "Mission Beach Rentals @Belmont" “San Diego Bike Rentals or "Cheap Rentals". Further, the undersigned will at all times while using equipment (including but not limited to: in-line skates, bicycles, skateboards, surfboards, bodyboards, skimboards, snorkel gear, stand up paddle boards, kayaks, chairs and umbrellas) rented from "Mission Beach Rentals @Belmont" “San Diego Bike Rentals” or "Cheap Rentals", operate aforementioned equipment safely and under control at all times and if inexperienced in the use of said equipment (including but not limited to: in-line skates, bicycles, skateboards, surfboards, bodyboards, skimboards, snorkel gear, stand up paddle boards, kayaks, chairs and umbrellas) will operate equipment slowly, avoid hills which will cause acceleration, avoid traffic of all kind, avoid deep water and/or unsafe areas and situations, will use equipment only where it is legal and safe in the manner that the equipment was intended for. Users will also avoid all "trick" or "stunt" maneuvers. The undersigned further acknowledges he/she is aware that participating in bicycling, skateboarding, in-line skating, surfing, kayaking, paddle boarding, bodyboarding or skimboarding involves the risk of personal injury or death from falling, drowning or striking another person or object while using the equipment (including but not limited to: in-line skates, bicycles, skateboards, surfboards, bodyboards, skimboards, snorkel gear, stand up paddle boards, kayaks, chairs and umbrellas). The undersigned further acknowledges that he/she will keep the equipment for a period of no longer than 30 days and that upon returning equipment he/she will assume all financial liability of any broken, damaged or severely worn equipment above normal wear and tear. The undersigned further acknowledges that employees of "Mission Beach Rentals @Belmont" or "Cheap Rentals" has the full and final decision to charge the given credit card and/or retain the partial or full deposit when equipment is not returned or is returned in a broken, damaged or severely worn state. The undersigned further acknowledges that the cost of U.S. dollars from either the deposit or other required financial sources that is to be retained in the event of lost, stolen, broken, damaged or severely worn equipment shall not exceed the amount that is needed to reimburse "Mission Beach Rentals @Belmont", “San Diego Bike Rentals”, "Cheap Rentals", “Beach RELM, LLC” and/or "Superdragon Inc." the cost to fully repair or replace the equipment that was lost, stolen, broken, damaged or severely worn and also the amount needed to reimburse "Mission Beach Rentals @Belmont", "Cheap Rentals" “San Diego Bike Rentals”, “Beach RELM, LLC”, and/or "Superdragon Inc." of the full rental value that the equipment is no longer available for rent while being replaced or repaired as a result of being lost, stolen, broken, damaged or severely worn. NOTWITHSTANDING SUCH RISKS, THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY AND ALL RISKS AND HAZARDS ARISING FROM OR IN ANY WAY CONNECTED TO THE RENTAL OF EQUIPMENT (INCLUDING BUT NOT LIMITED TO: IN-LINE SKATES, BICYCLES, SKATEBOARDS, SURFBOARDS, BODYBOARDS, SKIMBOARDS, SNORKEL GEAR, STAND UP PADDLE BOARDS, KAYAKS, CHAIRS AND UMBRELLAS). THE UNDERSIGNED WAIVES ANY RIGHT OF ACTION, CLAIM OR SUIT HE/SHE MAY HAVE AGAINST "MISSION BEACH RENTALS @BELMONT", "CHEAP RENTALS", "SUPERDRAGON INC.", IT'S OFFICERS, OWNERS, AGENTS, SUPPLIERS OR EMPLOYEES ARISING OUT OF THE USE OF THE EQUIPMENT (INCLUDING BUT NOT LIMITED TO: IN-LINE SKATES, BICYCLES, SKATEBOARDS, SURFBOARDS, BODYBOARDS, SKIMBOARDS, SNORKEL GEAR, STAND UP PADDLE BOARDS, KAYAKS, CHAIRS AND UMBRELLAS) RENTED FROM "MISSION BEACH RENTALS @BELMONT", "CHEAP RENTALS", and/or "SUPERDRAGON, INC.".
ALL RENTALS ARE SUBJECT TO ADDITIONAL CHARGES if not returned clean, dry, and in condition that is ready to rent upon return. Also, all rentals must returned no later than 30 minutes before closing.
The Undersigned further acknowledges that if any portion of this agreement is deemed to be illegal or unenforceable, then the rest of this agreement shall still remain valid and in effect.
THE UNDERSIGNED HEREBY RELEASES "MISSION BEACH RENTALS @BELMONT", "CHEAP RENTALS", “SAN DIEGO BIKE RENTALS”, “BEACH RELM, LLC”, "SUPERDRAGON INC.", IT'S OFFICERS, OWNERS, AGENTS, SUPPLIERS OR EMPLOYEES FROM ANY SUCH RIGHTS OF ACTION, CLAIMS OR SUITS.
I HAVE READ, UNDERSTAND AND AGREE TO THE FOREGOING WAIVER AND RELEASE.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
